Civil liability
According to the Civil Code of the People's Republic of China, no organization or individual may infringe upon the reputation rights of others through insults, defamation, or other means. Internet users and service providers who use the internet to infringe upon the civil rights and interests of others shall bear tort liability. If the perpetrator carries out news reporting, public opinion supervision and other actions for the public interest, which affects the reputation of others, specific conditions must be met to avoid civil liability.
Administrative responsibility
According to the Law of the People's Republic of China on Public Security Administration Punishments, those who spread rumors, falsely report dangerous situations, epidemics, police situations, or intentionally disrupt public order by other means shall be detained for not less than five days but not more than ten days and may be fined not more than 500 yuan; For minor offenses, detention for up to five days or a fine of up to five hundred yuan shall be imposed.
Criminal responsibility
According to the Criminal Law of the People's Republic of China, those who fabricate false dangerous situations, epidemics, disasters, or police situations and spread them on information networks or other media, seriously disrupting social order, shall be sentenced to fixed-term imprisonment of not more than three years, detention, or public surveillance; Those who cause serious consequences shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years. In addition, those who openly insult others or fabricate facts to defame others through violence or other methods, and the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, detention, surveillance, or deprivation of political rights.
